ALUGEAR ENGINEERS Sp. z o.o. (hereinafter referred to as "ALUGEAR," "we," "us," or "our") designs and manufactures precision CNC-machined bicycle chainrings, cranksets, aero covers, and related cycling components in Poland. ALUGEAR is also the designated responsible person under the EU General Product Safety Regulation (EU) 2023/988.
§ 2. Scope and Acceptance
2.1. These Terms of Service (hereinafter "Terms") govern all purchases made through the online store at alugear.com (the "Store"), which is hosted on the Shopify platform.
2.2. By placing an order, the Customer confirms that they have read, understood, and accepted these Terms. Acceptance is confirmed by ticking the checkbox at checkout, which is unchecked by default.
2.3. Consumer vs Business Customer. A "Consumer" is any natural person acting for purposes outside their trade, business, craft, or profession (as defined by Directive 2011/83/EU and the Polish Act on Consumer Rights of 30 May 2014). These Terms afford Consumers all mandatory protections of EU and Polish consumer law, including the right of withdrawal (see Return and Refund Policy) and the legal guarantee of conformity (§ 10). A "Business Customer" is any person or entity placing orders for professional or commercial purposes; certain consumer-specific provisions do not apply to Business Customers.
2.4. Separate terms apply to dealers, distributors, and wholesale buyers ordering through our B2B channel. For B2B terms, contact b2b@alugear.com.
2.5. In the event of a discrepancy between the English and Polish versions of these Terms, the Polish version shall prevail for Consumers habitually resident in Poland; for all other Consumers, the English version shall prevail.
2.6. ALUGEAR reserves the right to amend these Terms. Amendments apply only to orders placed after the updated version is published on the Store.
§ 3. Definitions
Customer — Any natural or legal person who places an order through the Store, whether a Consumer or a Business Customer.
Goods — All products offered for sale in the Store, including chainrings, cranksets, aero covers, bolts, and accessories.
Order — The Customer's offer to purchase Goods, submitted electronically through the Store's checkout process.
Order Confirmation — The email sent by ALUGEAR confirming acceptance of the Order, at which point the sales contract is concluded.
Working Day — Monday through Friday, excluding public holidays in Poland.
Processing Time — The period required for manufacturing, quality inspection, and packaging of the Goods before they are handed over to the carrier for shipping. Processing Time is separate from and precedes shipping/delivery time.
§ 4. Order Process, Processing Time and Modifications
4.1. Placing an Order. The Customer selects Goods, adds them to the shopping cart, provides delivery and billing information, selects a shipping method, selects a payment method, reviews the order summary (including total price), accepts these Terms, and submits the Order. Product listings in the Store constitute an invitation to treat, not a binding offer.
4.2. Contract formation. An Order constitutes a binding offer by the Customer. The sales contract is concluded only upon ALUGEAR sending the Order Confirmation by email. ALUGEAR reserves the right to decline an Order (e.g., if the product is out of stock or if fraud is suspected), in which case the Customer will be notified promptly and any payment already made will be refunded in full.
4.3. Input errors. The Customer may review and correct all data before submitting the Order. After submission, corrections must be requested by email to support@alugear.com.
4.4. Made-to-order products and Processing Time. Most ALUGEAR products are made to order — they are CNC-machined, finished, quality-inspected, and packaged after the Order is placed. The Processing Time is the period between Order Confirmation (or receipt of payment, for wire transfers) and the moment the Goods are dispatched to the carrier. Processing Time does not include shipping/delivery time.

Processing Time may vary depending on current production volume and component availability. If a longer Processing Time is expected for a specific product, this will be stated on the product page or communicated to the Customer by email after Order Confirmation. The total time from order to delivery is: Processing Time + Shipping Time (see Shipping Policy).
4.5. Order modifications and cancellations before dispatch. The Customer may request changes to an Order (e.g., product size, colour, delivery address) or cancel it entirely by emailing support@alugear.com, provided the Order has not yet been dispatched. Because most products are made to order, we encourage Customers to request modifications as early as possible — ideally before manufacturing has begun. We will confirm whether the modification or cancellation was possible. Once the Goods have been handed over to the carrier, the Order can no longer be cancelled or modified — the Consumer's 14-day right of withdrawal applies instead (see Return and Refund Policy).
4.6. Important note regarding made-to-order and the right of withdrawal. ALUGEAR products manufactured to standard specifications listed on the product page (e.g., a 50T round chainring for Shimano 110 BCD 4-bolt) are not considered custom or personalised goods under Article 16(c) of Directive 2011/83/EU, even though they are manufactured after the Order is placed. The Consumer's 14-day right of withdrawal applies to these products in full. Only products made to the Customer's own non-standard specifications (e.g., custom engravings or bespoke modifications not listed in the Store) are excluded from the right of withdrawal.
4.7. Auto-cancellation of unpaid wire-transfer orders. If payment by bank wire transfer has not been received and reconciled within 7 Working Days of Order Confirmation, the Order may be cancelled automatically. The Customer will be notified by email before cancellation.
§ 5. Pricing, Currency and Payment
5.1. Prices and VAT. All prices displayed in the Store are quoted in EUR (or the currency selected by the Customer where available). For Customers within the European Union, prices include VAT. For Customers outside the EU, prices may be displayed VAT-exclusive at checkout — this will be clearly indicated.
5.2. Total price. The total price shown at the final checkout step includes the price of the Goods, applicable VAT, and shipping costs. No hidden fees will be added after this point. For non-EU Customers, customs duties and import taxes are additional charges not included in the total price (see Shipping Policy).
5.3. Currency conversion. The contractual currency is the currency displayed at checkout. If the Customer pays in a different currency (e.g., via a credit card denominated in GBP or USD), the exchange rate and any conversion fees are determined by the Customer's card issuer or payment provider. ALUGEAR is not responsible for differences arising from currency conversion.
5.4. Accepted payment methods:
- Credit / debit card (Visa, Mastercard, American Express) — processed via Shopify Payments with 3-D Secure (SCA) authentication as required by PSD2. ALUGEAR does not store card details.
- PayPal — processed through the Customer's PayPal account.
- Bank wire transfer — bank details are provided at checkout and in the Order Confirmation email. To expedite dispatch, the Customer should email a payment confirmation to support@alugear.com with the subject line "Order payment confirmation — [Order Reference]."
5.5. Refund method. Refunds will be processed using the same payment method as the original transaction, unless the Customer explicitly agrees to an alternative.
§ 6. Product Descriptions and Accuracy
6.1. We make every effort to display the colours and details of our products as accurately as possible. However, actual colours may vary depending on your screen and device settings. We do not guarantee that colour representations on screen will be identical to the physical product.
6.2. All product descriptions, specifications, and pricing are subject to change without notice. We reserve the right to discontinue any product at any time.
6.3. In the event of a typographical or pricing error on the Store, ALUGEAR reserves the right to correct the error and cancel or decline any orders placed at the incorrect price. If payment has already been processed, ALUGEAR will issue a full refund.
§ 7. Product Compatibility and Fitment
7.1. Customer's responsibility. Cycling chainrings must be matched to specific cranksets, bottom bracket standards, chain types, drivetrain speeds, offsets, and frame clearances. It is the Customer's responsibility to verify, before placing the Order, that the selected Goods are compatible with the Customer's existing equipment. ALUGEAR publishes detailed compatibility specifications on each product page, including BCD (bolt circle diameter), direct-mount standard, offset, tooth count, and chain type.
7.2. Pre-purchase compatibility confirmation. ALUGEAR strongly recommends that Customers who are uncertain about compatibility contact us before ordering. Email support@alugear.com with a photo of your crankset and details of your groupset — our team will confirm compatibility, typically within 1 Working Day. Where ALUGEAR has confirmed compatibility in writing (via email) prior to purchase based on information provided by the Customer, and the Goods turn out to be incompatible with the components disclosed, ALUGEAR will accept the return of uninstalled Goods without any diminished-value deduction.
7.3. No defect due to incompatibility. Goods supplied in accordance with the specifications selected by the Customer at checkout shall not be considered defective solely on the basis of incompatibility with components that were not disclosed to ALUGEAR at the time of order.
7.4. Common compatibility factors to verify before ordering:
- Mounting standard: BCD (110 mm 4-bolt asymmetric, 110 mm 4-bolt symmetric, 130 mm, 96 mm, 104 mm) or direct-mount (Shimano, SRAM 3-bolt, SRAM 8-bolt, Race Face Cinch, Cannondale, Rotor).
- Chainring offset: Particularly important for 1x setups to maintain correct chainline.
- Speed / chain type: 10-speed, 11-speed, 12-speed; HG, HG+, Flat Top, or Campagnolo chain standards.
- 1x vs 2x configuration: Narrow-wide tooth profile for 1x drivetrains; matched inner/outer rings for 2x drivetrains.
- Power meter clearance: Some chainring and power meter combinations require specific offsets or clearances.
- Frame and front derailleur clearance: Larger tooth counts or oval-shaped chainrings may require additional clearance.
§ 8. Included Hardware and Accessories
8.1. The contents of each product package are listed on the product page under "What's included" or in the product description. Mounting bolts and hardware may or may not be included depending on the product — please verify on the product page before ordering.
8.2. In many cases, the Customer's existing OEM chainring bolts can be reused. If you are unsure whether your existing bolts are compatible or whether you need to purchase bolts separately, contact support@alugear.com.
§ 9. Legal Guarantee of Conformity (2 Years)
9.1. Under EU law (Directive (EU) 2019/771 on the sale of goods, transposed into Polish law), all Consumers are entitled to a minimum 2-year legal guarantee of conformity on all Goods purchased from ALUGEAR.
9.2. What this means. If the Goods prove to be defective or not in conformity with the contract at any time within 2 years from delivery, you are entitled to a remedy free of charge. Lack of conformity includes: Goods that do not match their description, type, quantity, or quality; Goods not fit for any particular purpose communicated by the Customer and accepted by ALUGEAR; Goods not fit for the purposes for which goods of the same type would normally be used; Goods that do not possess the qualities and features normal for goods of the same type that the Consumer may reasonably expect.
9.3. Burden of proof. For defects appearing within the first 12 months from delivery, it is presumed that the lack of conformity existed at the time of delivery (unless this is incompatible with the nature of the Goods or the nature of the lack of conformity). After the first 12 months, the Consumer may need to demonstrate that the defect was present at delivery.
9.4. Remedies. Under Polish law, the Consumer has a free choice between:
- Repair (free of charge, within a reasonable time, without significant inconvenience);
- Replacement with a conforming product;
- Price reduction proportionate to the deficiency; or
- Contract termination (full refund), provided the lack of conformity is not minor.
ALUGEAR may offer an alternative remedy only if the remedy chosen by the Consumer is impossible or would entail disproportionate costs.
9.5. How to make a claim. Contact support@alugear.com with your Order Reference, a description of the defect, and photographs. We will respond within 14 days.
9.6. This legal guarantee is independent of and additional to the commercial warranty described in § 10.
§ 10. ALUGEAR Commercial Warranty (1 Year)
10.1. Coverage. In addition to the statutory legal guarantee (§ 9), ALUGEAR voluntarily warrants its Goods to be free from defects in materials and workmanship for a period of 1 year from the original date of purchase. Any product found to be defective within this period will be repaired or replaced at ALUGEAR's discretion, free of charge.
10.2. This commercial warranty does not limit or replace the legal guarantee of conformity (§ 9). The Consumer retains all rights under the legal guarantee regardless of this warranty.
10.3. What is NOT covered by this warranty:
- Normal wear and tear, including chainring tooth wear from regular use;
- Cosmetic changes, including fading or discolouration of anodised surfaces due to UV exposure, cleaning agents, or chain lubricant;
- Damage resulting from crashes, impacts, or accidents;
- Damage caused by improper installation, including incorrect torque application or failure to follow the supplied installation instructions;
- Use with incompatible components (chains, cranksets, bottom brackets, or cassettes not approved by ALUGEAR for the specific product — see § 7);
- Modifications, machining, drilling, or re-anodising of the product by the Customer or a third party;
- Use on e-bikes exceeding the product's stated torque and power ratings;
- Use in commercial rental fleets or motorpacing applications.
10.4. Warranty claim procedure. Contact support@alugear.com with: (1) your Order Reference or proof of purchase; (2) a clear description of the defect; (3) photographs showing the issue. ALUGEAR will assess the claim and respond within 14 days. If the warranty claim is approved, ALUGEAR will cover shipping costs for the replacement product.
§ 11. Product Use, Safety and Limitation of Liability
11.1. Installation. ALUGEAR Goods must be installed by a competent bicycle mechanic or a person with adequate technical knowledge, following the installation instructions and torque specifications provided with the product. Incorrect installation may result in component failure, personal injury, or property damage.
11.2. Intended use. ALUGEAR products are designed for use on human-powered bicycles within the scope described on the product page (road, gravel, mountain bike, or triathlon). Use outside the intended discipline, on motorised vehicles, or in conditions exceeding the product's stated specifications is at the Customer's own risk.
11.3. Product safety and recalls. In compliance with the EU General Product Safety Regulation (EU) 2023/988, ALUGEAR maintains post-market surveillance of its products. In the event of a product recall, affected Customers will be notified by email and information will be published on the Store.
11.4. Limitation of liability. To the maximum extent permitted by applicable law:
- ALUGEAR's total aggregate liability under or in connection with the contract shall not exceed the price paid by the Customer for the Goods giving rise to the claim.
- ALUGEAR shall not be liable for any indirect, incidental, consequential, or special damages (including loss of revenue, loss of data, or loss of use).
Nothing in these Terms shall limit or exclude ALUGEAR's liability for: (a) death or personal injury caused by gross negligence or wilful misconduct; (b) fraud or fraudulent misrepresentation; or (c) any liability that cannot be excluded or limited under mandatory Polish or EU law.
§ 12. Intellectual Property
12.1. The name "ALUGEAR," the ALUGEAR logo, product designs, and all content on the Store (including text, photographs, graphics, and software) are the intellectual property of ALUGEAR ENGINEERS Sp. z o.o. or its licensors and are protected by applicable intellectual property laws.
12.2. The Customer is granted a limited, non-exclusive, non-transferable right to access and view the Store for personal, non-commercial use. No content may be copied, reproduced, distributed, or used commercially without ALUGEAR's prior written consent.
§ 13. User-Generated Content and Feedback
13.1. If you submit reviews, photographs, suggestions, or other content ("Feedback") through the Store, you grant ALUGEAR a non-exclusive, worldwide, royalty-free licence to use, reproduce, modify, and display such Feedback in connection with operating and improving the Store.
13.2. You represent that your Feedback is accurate, does not infringe any third-party rights, and does not contain unlawful, offensive, or harmful content. ALUGEAR may remove any Feedback at its discretion.
§ 14. Prohibited Uses
14.1. You may access and use the Store for lawful purposes only. You may not use the Store to: (a) violate any applicable law or regulation; (b) infringe upon intellectual property rights; (c) transmit malicious code, spam, or misleading information; (d) collect personal information of others; (e) interfere with or circumvent the Store's security features; or (f) use automated tools, scrapers, bots, or AI agents to access the Store without prior written consent.
14.2. ALUGEAR reserves the right to suspend or terminate access to the Store for any violation of these Terms.
§ 15. Relationship with Shopify
15.1. The Store is hosted on the Shopify platform. All sales are made directly between the Customer and ALUGEAR. Shopify is not a party to any transaction and is not responsible for any aspect of the sale, including the Goods, delivery, or customer support.
15.2. By using the Store, the Customer acknowledges that Shopify collects and processes certain personal data in connection with providing the platform. See our Privacy Policy for details.
§ 16. Complaints, ADR and ODR
16.1. Complaints. The Customer may submit complaints by email to support@alugear.com. ALUGEAR will acknowledge receipt and respond within 14 days.
16.2. EU Online Dispute Resolution. The European Commission provides an Online Dispute Resolution (ODR) platform at: https://ec.europa.eu/consumers/odr.
16.3. Alternative Dispute Resolution (ADR). In Poland, Consumers may seek out-of-court dispute resolution through the Provincial Inspectorates of the Trade Inspection (Wojewódzki Inspektorat Inspekcji Handlowej). More information: https://www.uokik.gov.pl.
§ 17. Force Majeure
17.1. ALUGEAR shall not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond its reasonable control, including: natural disasters, pandemics, war, government actions, trade embargoes, carrier strikes, customs delays, raw material shortages, or IT system disruptions.
17.2. If performance remains impossible for more than 30 days, either party may terminate the contract by written notice, and the Customer will be entitled to a full refund.
§ 18. Governing Law and Jurisdiction
18.1. These Terms and all contracts concluded through the Store are governed by the laws of the Republic of Poland.
18.2. Consumers. The choice of Polish law does not deprive Consumers of the protection afforded to them by mandatory provisions of the law of the country in which the Consumer has their habitual residence (Article 6(2) of Regulation (EC) No 593/2008 — Rome I). Consumers may bring proceedings in the courts of their habitual residence (Brussels I bis Regulation (EU) No 1215/2012).
18.3. Business Customers. Disputes with Business Customers shall be subject to the exclusive jurisdiction of the courts competent for the registered seat of ALUGEAR (Kraków, Poland).
§ 19. Severability
19.1. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
§ 20. Dealer and Wholesale Inquiries
20.1. Bicycle shops, distributors, team managers, and professional athletes interested in dealer pricing or wholesale orders are invited to contact b2b@alugear.com. Dealer and wholesale orders are governed by separate B2B terms and conditions.
§ 21. Changes to Terms
21.1. We reserve the right to update these Terms at any time. Changes apply only to orders placed after publication. Material changes will be communicated in accordance with applicable law. Your continued use of the Store after changes are posted constitutes acceptance of the updated Terms.
